255 PRINCIPLES OF DISAGREEMENT BETWEEN CONTRACTORS By Wafa Abdul Muti Khalawi Khdair Supervisor Dr. Aref Abu Eid ABSTRACT This study examined the matter of Arbitration between the contractors, aiming to show the means of arbitration and solving problems between the contractors, if any conflict has raised on contract. Because there are many field and possibilities of conflict, this study was done in eight chapters. First Chapter shows the meaning of the contracting and conflict, and it shows some methods of solving conflicts between contractors such as judiciary and Arbitration. In the Second Chapter I have discussed some of conflict principles in the original contract, and showing methods of solving the conflict if any party has pretended the invalidity of the contract, while the others pretended it's validity. In The Third Chapter, I have discussed the different meanings of the contract's wordings, in which some words may bear more than one meaning, or it is customs used to determine a special meaning. In the Fourth Chapter I have discussed conflicts caused when contractors don't agree on the contracting subject's such as the Compensation Contracts, Partnerships or Documentation, showing ways of alliances and its effects on the contract. The Fifth Chapter, I discussed the contracts when there is a different in timings and conditions. The Sixth Chapter, I discussed the principles of solving conflicts between contractors if there is a deficiency in contract's subject, wither the difference was in on the time of contract or the knowledge of it.
256 The Seventh Chapter, it examined two contracts, The Marriage Contract and the Surrender Contract, because these two contracts have special principles. The Eighth Chapter, I explained the meaning of jesting and Formalities and examined some of its principles, and showed its effects on the contract.
